Terms & Conditions

Advertiser Terms of Service & Campaign Agreement

By submitting, purchasing, or authorizing an advertising campaign through Pushpin Kiosk, the Advertiser acknowledges and agrees to the following terms, conditions, and operational policies.
1. Advertiser Responsibility & Host Compatibility
The Advertiser is responsible for reviewing and approving all submitted advertising content before it is submitted for publication.
The Advertiser represents and warrants that all advertisements, images, text, offers, contact information, pricing, claims, and other materials are accurate, lawful, and suitable for display on the Pushpin Kiosk network.
Advertisements must not conflict with the products, services, policies, or business operations of the physical location hosting a Pushpin Kiosk. Pushpin Kiosk reserves the right to decline, modify, remove, or restrict an advertisement that is incompatible with a host location.
2. Advertising Platform & No Performance Guarantee
Pushpin Kiosk provides digital advertising placement and distribution through its participating kiosk locations.
The Advertiser acknowledges that advertising results may vary. Pushpin Kiosk does not guarantee any specific level of:

  • Customer traffic

  • Sales or revenue

  • Leads or inquiries

  • New customers

  • Website visits

  • Click-throughs

  • Calls, messages, or other customer responses

Purchasing advertising space does not constitute a guarantee of business results.
3. Campaign Runtime & Service Interruptions
Pushpin Kiosk will make reasonable efforts to operate campaigns for the purchased campaign period at the selected kiosk locations.
Temporary interruptions may occur because of power outages, internet or network disruptions, equipment failure, software issues, maintenance, repairs, or other circumstances beyond Pushpin Kiosk's reasonable control.
If a documented service interruption prevents a campaign from operating for more than seventy-two (72) consecutive hours at a designated location, Pushpin Kiosk may, at its discretion:

  1. Extend the campaign for the documented lost advertising time; or

  2. Provide a pro-rated credit or refund for the documented lost advertising time.

Any approved refund or credit will be processed within fourteen (14) business days.
4. Accuracy & Creative Responsibility
The Advertiser is solely responsible for the accuracy and legality of all submitted advertising materials.
Pushpin Kiosk is not responsible for errors contained in materials submitted or approved by the Advertiser, including:

  • Misspellings

  • Incorrect dates or times

  • Incorrect prices

  • Incorrect addresses or contact information

  • Incorrect website or social-media information

  • Unsubstantiated or inaccurate claims

  • Incorrect promotional details

If an Advertiser requests a correction after an advertisement has been approved or deployed, an applicable editing or processing fee may apply.
5. Privacy & Campaign Information
Pushpin Kiosk will use reasonable measures to protect Advertiser account information and campaign data.
Pushpin Kiosk will not sell or intentionally disclose private Advertiser information to third parties except as necessary to operate the service, process payments, comply with applicable law, respond to legal requests, or fulfill services authorized by the Advertiser.
Advertisers should not submit confidential information that is not necessary for the operation of their advertising campaign.
6. Payment & Campaign Activation
Pre-Paid Advertising
Advertising campaigns must be paid in full before the campaign is activated.
A campaign will not be placed into the active display queue until payment has been successfully received and the submitted advertisement has been approved.
7. New Kiosk Locations
If an Advertiser is actively advertising at all participating Pushpin Kiosk locations when a new kiosk location is added to the network, Pushpin Kiosk may extend the Advertiser's campaign to the new kiosk at no additional charge for the remainder of the current campaign period.
This benefit is subject to host-location compatibility and available advertising space.
8. Submission Deadline
Advertisers should submit completed advertising materials at least forty-eight (48) hours before the requested campaign start date.
Pushpin Kiosk may require additional time when creative materials need review, resizing, formatting, technical preparation, or correction.
Submission of materials does not guarantee approval or a specific start time.
9. Campaign Cancellation
An Advertiser may request cancellation of an active campaign by contacting Pushpin Kiosk.
If an early cancellation is approved, Pushpin Kiosk may deduct a 20% administrative fee from any eligible unused campaign balance before calculating an applicable refund or credit.
10. Refund Policy
Refund eligibility depends on the campaign type, campaign period, and amount of advertising time already used.
Unless otherwise stated in writing, advertising time that has already been delivered is non-refundable.
For campaigns sold in fixed billing periods, any refund will be calculated based on the unused portion of the applicable campaign period, subject to the cancellation and administrative-fee provisions above.
Important: Short-term campaigns, such as 5-day or weekly campaigns, may have different refund rules than monthly or annual campaigns.
11. Campaign Expiration
When the purchased campaign period ends, the advertisement will be removed from the active advertising rotation.
No additional advertising charges will apply unless the Advertiser authorizes an extension, renewal, or new campaign.
12. Host-Location Restrictions
Advertisements must be compatible with the business hosting the kiosk.
For example, if a kiosk is located inside a business that sells a particular product or service, Pushpin Kiosk may restrict advertisements that directly conflict with that host's offerings.
If an Advertiser selects all available locations, Pushpin Kiosk may exclude a location where the advertisement conflicts with the host business. The Advertiser will not be charged an additional fee for an excluded location.
13. Campaign Editing
Advertisers may request changes to an advertisement after submission, subject to the following policies:
Annual Sales Campaigns
Up to three (3) advertisement edits per annual sales campaign may be permitted at no additional charge.
Weekly or Monthly Campaigns
Editing requests for weekly or monthly campaigns may be subject to a $20.00 editing fee per approved change.
Edits may require additional processing time and are not guaranteed to appear immediately.
14. Extended Display Slots
Certain campaigns may be eligible for extended display time or additional advertising slots.
Additional or longer display slots may increase the campaign price. Any additional cost will be communicated to the Advertiser before the expanded placement is activated.
15. Right to Reject or Remove Advertising
Pushpin Kiosk reserves the right to reject, suspend, modify, or remove any advertisement that it reasonably believes:

  • Violates applicable law or regulation

  • Contains misleading or deceptive information

  • Is inappropriate for the kiosk's audience or host location

  • Conflicts with a host business

  • Violates Pushpin Kiosk policies

  • Creates a legal, technical, or operational concern

If an advertisement is rejected before deployment, Pushpin Kiosk may provide the Advertiser an opportunity to submit revised materials.
16. Advertiser Indemnification
To the extent permitted by applicable law, the Advertiser is responsible for claims arising from the Advertiser's submitted advertising content, including claims involving intellectual-property rights, inaccurate statements, unauthorized use of images or trademarks, or other content supplied by the Advertiser.
The Advertiser represents that it has the necessary rights and permissions to use all submitted images, logos, photographs, trademarks, text, and other creative materials.
17. Acceptance of Terms
By submitting an advertising campaign, making payment, or authorizing Pushpin Kiosk to display advertising materials, the Advertiser confirms that they have read, understood, and agreed to these Advertiser Terms of Service & Campaign Agreement.
Pushpin Kiosk reserves the right to update these terms from time to time. The terms applicable to a campaign will be those accepted by the Advertiser at the time of purchase or campaign authorization.
Advertiser Acknowledgment:
I confirm that I have reviewed my advertisement, understand these terms, and authorize Pushpin Kiosk to display my campaign according to the selected campaign options.
